What you can do on Causfy, what you cannot, and who is answerable for what.

Introduction and acceptance

These Terms apply to anyone who accesses or uses Causfy, creates a Cause, supports one, or otherwise interacts with the Platform.

1.1. Purpose. These Terms govern access to and use of the Platform and the Services, and define the relationship between Causfy and the User.

1.2. Acceptance. Accessing or using the Platform means accepting these Terms in full. Anyone who does not accept them must refrain from using the Services.

1.3. Who provides the service. “Causfy”, “the Platform”, “we” and equivalent expressions refer to CAUSFY GLOBAL TECHNOLOGIES, S.L., a Spanish company whose identification and contact details appear in the final section.

1.4. Complementary documents. The Privacy Policy, the Cookie Policy, the Platform Guidelines and the Artificial Intelligence Policy form part of these Terms and prevail in their own subject matter. Platforms provided under a third party’s own identity are governed by their specific contract.

Definitions

For the purposes of these Terms, the following terms have the meaning set out below, whether used in the singular or the plural.

2.1. Contribution. A financial contribution made by a User to a Cause.

2.2. Support. An expression of backing for a Cause, in the form of a Signature or a Contribution.

2.3. Cause. An initiative published on the Platform by a Creator in order to gather Support for a specific objective.

2.4. User Content. Any material added to the Platform by a User, including text, images, updates, comments and messages.

2.5. Creator. A User who creates and manages a Cause, whether an individual, a legal entity or an organisation.

2.6. Account. The unique record associated with a User for access to the Services.

2.7. Recipient. The person, entity or body to whom the request made in a Cause is addressed.

2.8. Signature. An expression of support for a Cause by which a User adds their backing to what it requests.

2.9. Platform. The websites, applications and developments through which the Services are provided, on the domains causfy.com, causfy.org and causfy.app.

2.10. Services. The features made available to Users through the Platform.

2.11. User. Any person who accesses or uses the Platform, whether or not they have an Account.

Nature of the service

3.1. What the Platform does. The Platform allows Causes to be created and Support to be gathered for them. Each Cause admits a single type of Support, which its Creator determines when creating it.

3.2. Causfy’s position. Causfy acts as a provider of an intermediation service. It is not a party to the relationship between the Creator, those who support a Cause and its Recipient.

3.3. No endorsement. The publication of a Cause does not imply endorsement, verification or agreement by Causfy with its content, or with the truth of what it states. Responsibility for the content of a Cause lies with its Creator.

3.4. No guarantee of outcome. Causfy does not guarantee that a Cause will reach a given number of Supports, that its Recipient will respond, or that it will have any effect.

3.5. No advice. The Services do not constitute legal, tax, medical or financial advice.

3.6. Payment services. Causfy is not a payment institution. Financial transactions are carried out through independent payment service providers, subject to their own conditions.

3.7. Changes to the service. Causfy may modify, add or withdraw features. Changes that substantially affect Users will be notified at least thirty calendar days in advance.

Access and account

4.1. Capacity. Access to the Services requires being over eighteen years of age and having capacity to be bound by these Terms. This age requirement applies equally to anyone supporting a Cause without an Account. Anyone creating an Account on behalf of a legal entity or an organisation declares that they have sufficient authority to bind it.

4.2. Declaration of age. Age is established by the User’s own declaration. Causfy carries out no further checks.

4.3. Accuracy. The details provided must be true and kept up to date.

4.4. One account. Each User may hold a single Account. Creating additional Accounts in order to circumvent a restriction imposed under these Terms is not permitted.

4.5. Personal nature. The Account is personal and non-transferable. It may not be assigned, sold or made available to third parties.

4.6. Safekeeping. The User is answerable for actions taken from their Account and must report any unauthorised access without delay.

4.7. Impersonation. Acting on behalf of another person, entity or organisation without authority to do so is not permitted.

4.8. Territorial restrictions. Access to certain Services may be unavailable in countries subject to international sanctions or excluded by the payment service providers.

4.9. Voluntary closure. The User may request the closure of their Account at any time from the Platform itself. The consequences for their data are governed by the Privacy Policy, subject to the exceptions set out in the section on the record of Signatures.

Causes

5.1. Prior review. Every Cause is reviewed before publication. Until that review concludes, the Cause is not publicly accessible.

5.2. Means used. The review combines automated means and human review.

5.3. Review by a person. A Creator whose Cause has been rejected, suspended or withdrawn may request that the decision be reviewed by a person, in accordance with the section on moderation.

5.4. Changes by the Creator. The Creator may amend their Cause after publication, provided the amendments do not alter what is being requested or the purpose for which the Support already obtained was gathered.

5.5. Duration. A Cause remains published until its Creator closes it or until Causfy takes one of the measures set out in the section on moderation.

5.6. Closure of the Creator’s Account. Closing the Creator’s Account closes their Causes.

5.7. Effect of withdrawal. The withdrawal or closure of a Cause does not affect the validity of Support already given or the records generated.

User content and visibility of support

6.1. Ownership. User Content continues to belong to whoever adds it to the Platform.

6.2. Licence. By publishing User Content, the User grants Causfy a free, worldwide and non-exclusive licence to reproduce, communicate to the public, adapt and display it, for the sole purpose of providing and promoting the Services. The licence ends when the content is withdrawn, except in backups and where its retention is mandatory.

6.3. Declaration. Anyone publishing User Content declares that they hold the necessary rights to do so and that it does not infringe the rights of third parties.

6.4. Public nature of a Cause. The content of a Cause is accessible to any visitor and may be indexed by search engines.

6.5. Visibility of Support. Anyone supporting a Cause decides which details are shown publicly alongside their Support, and may choose for none to be shown. The email address is never displayed.

6.6. Information provided to the Creator. The Creator has access to the list of Support received by their Cause and may download it. That list comprises the name given, where there is one, and the email address of those who have supported it, and constitutes the record of the Support obtained. Its scope may vary depending on the type of Cause, and this is notified before Support is given.

6.7. Communications from the Creator. The Creator may contact those who have supported their Cause only through the Platform’s own features.

6.8. The Creator’s own measurement tools. The Platform allows the Creator to add their own measurement identifiers to their Cause page. Anyone activating that feature accepts the following:

a) They are the controller of the processing carried out by those tools and of the data obtained through them. Causfy does not take part in that processing, does not access that data and does not receive it.

b) They must have a lawful basis for that processing and their own privacy information, accessible to anyone visiting their Cause.

c) They may not use the data obtained for any purpose other than promoting the Cause for which the feature was activated, nor pass it to third parties for another purpose.

d) Causfy may deactivate the identifiers at any time, without notice, where it identifies a use contrary to these Terms, to the Platform Guidelines or to applicable law, or where it receives a well-founded complaint.

e) They will be answerable to Causfy for claims, penalties and costs arising from the use of those tools, and will hold Causfy harmless against them.

6.9. Consent of the visitor. Loading the tools referred to above is conditional on the prior consent of the person visiting the Cause, which is obtained on the Platform itself and separately. The Creator may not give that consent on behalf of third parties or require it as a condition for supporting the Cause.

6.10. Withdrawing Support. Anyone who has signed a Cause may withdraw their Signature at any time, and it is then excluded from the count.

Prohibited conduct and content

7.1. The Platform may not be used to:

a) Carry out unlawful activities or promote them.

b) Attack or demean people or groups on grounds of origin, ethnicity, religion, beliefs, sex, gender identity, sexual orientation, age, disability, illness or any other personal or social circumstance.

c) Threaten, harass, intimidate or impersonate others.

d) Incite violence or glorify it.

e) Put minors at risk.

f) Disclose other people’s personal data without authority to do so, including home addresses, telephone numbers, identity documents, bank details and images taken in private settings.

g) Mislead through false Causes, non-existent beneficiaries or statements the User knows to be inaccurate.

h) Distribute sexually explicit or gratuitously violent content.

i) Sell products or services, insert advertising or send unsolicited bulk messages.

j) Infringe third-party intellectual or industrial property rights.

k) Automate access, extract data on a large scale, interfere with the operation of the Platform or circumvent its security measures.

7.2. A Cause must match its purpose. A Cause must serve the purpose for which it was created. It may not be used to obtain support intended for a purpose other than the one stated.

Moderation, measures and appeal

8.1. Measures. Where these Terms are breached, Causfy may remove the content, exclude it from the public catalogue, prevent its promotion, suspend the Account temporarily or close it. The least severe effective measure will be applied, except in particularly serious or repeated cases.

8.2. Reasons and notification. Any measure taken in respect of a Cause or an Account will be notified to the person affected, stating the reason.

8.3. Advance notice. The closure of an Account will be notified in advance, except in particularly serious cases or where a legal obligation prevents it.

8.4. Appeal. The person affected may appeal against the measure within six months of being notified. Receipt of the appeal will be confirmed within twenty-four to forty-eight working hours. The appeal will be examined by a person other than the one who took the decision and will be decided with reasons within a maximum of fifteen calendar days.

8.5. Reporting unlawful content. Anyone, whether or not they have an Account, may report content they consider unlawful or contrary to these Terms, stating where it is and why. Reports are dealt with within twenty-four to forty-eight working hours. Where further checks are required, the person reporting will be informed. Reports are sent to:

Financial contributions

9.1. Free of charge. Creating, publishing, maintaining and closing a Cause is free.

9.2. No commission. Causfy takes no commission on the amount gathered by a Cause. Any change to this will be notified at least thirty calendar days in advance.

9.3. Means of Contribution. Contributions may be made by card, bank transfer or direct debit and by stablecoins, through the means enabled on the Platform at any given time.

9.4. Contributions that do not pass through the Platform. Where the means used involves a direct transfer to the recipient, the transaction takes place between the contributor and the recipient. Causfy does not take part in it, does not hold the funds and cannot reverse it.

9.5. Services subject to a charge. Certain Services may be subject to a charge. Before contracting them, the amount, applicable taxes and content of the service will be stated.

9.6. Third-party costs. Payment service providers apply their own fees, which are not received by Causfy.

9.7. Use of Contributions. Contributions go to the Cause. The recipient is answerable for applying them to the purpose stated, for complying with their tax obligations and for obtaining any authorisations required to raise funds.

9.8. Withholding. Causfy may withhold or suspend access to funds where there are indications of fraud or breach of these Terms, or where a competent authority so requires. This power extends only to funds over which Causfy has control.

9.9. Refunds. Contributions will be refunded where a Cause is withdrawn for fraud or serious breach of these Terms, to the extent the payment method used allows.

9.10. Withdrawal. A User who is a consumer has fourteen calendar days to withdraw from a Service subject to a charge. Where performance begins at the User’s express request within that period, the right of withdrawal is lost once it has been fully performed, and the User will be informed of this before contracting.

Record of signatures

10.1. Record. Each confirmed Signature generates a documentary record of which a permanent entry is kept.

10.2. Content of the entry. The entry contains no personal data and does not allow the signatory to be identified, nor the content of the Cause to be known.

10.3. Irreversibility. Once made, the entry cannot be deleted, either by Causfy or by anyone else.

10.4. Compatibility with erasure. Erasure of the signatory’s personal data may be requested under the Privacy Policy and is unaffected by the above, since the entry identifies no one.

10.5. What it evidences. The record evidences that the Signature took place and that the document has not been altered since. It does not evidence the truth of the content of the Cause.

Liability and third-party rights

11.1. Availability. The Services are provided as available. Causfy does not guarantee the absence of interruptions or errors.

11.2. Exclusions. Causfy is not answerable for the content of Causes, for the conduct of their Creators, for the use made of the funds gathered, for relationships between Users or with Recipients, or for services provided by third parties.

11.3. Limits. Nothing in this section excludes liability for wilful misconduct or gross negligence, or liability whose exclusion is not permitted, and it does not affect the rights the User has as a consumer.

11.4. Third-party services. The Platform may contain links to external sites and use external providers. Their use is governed by the conditions of their respective owners.

11.5. Causfy’s rights. The Causfy name, its distinctive signs, the software and the design of the Platform belong to Causfy or are used under licence. Their reproduction, transformation, distribution or commercial use is not authorised without written permission.

11.6. Third-party claims. Anyone who considers that published content infringes their rights may report it as set out in the section on moderation, identifying the content and the right invoked.

Final provisions

12.1. Changes. Causfy may amend these Terms. Substantial changes will be notified at least thirty calendar days in advance, during which the User may close their Account if they do not accept them. Non-substantial changes will be published with an updated date.

12.2. Governing law. These Terms are governed by Spanish law.

12.3. Jurisdiction. The courts of Madrid shall have jurisdiction. A User who is a consumer may bring proceedings before the courts of their own domicile and may also use the European online dispute resolution platform.

12.4. Language. The Spanish version is the original. Versions in other languages are courtesy translations and, in the event of any discrepancy, the Spanish version prevails.
