Important Legal Notice: This Program is NOT an insurance product and does NOT constitute an absolute or unconditional guarantee of refund. It is a discretionary review, traceability, and support program. Causfy does not directly custody donor funds. Any refund approved under this Program is a discretionary benefit, not an admission of liability. These terms are governed by Spanish law.
1. Purpose
The Causfy Donation Protection Program (“Program”) exists to provide a formal review pathway in eligible cases where there is credible evidence of fraud, impersonation, or material misrepresentation related to a donation made through Causfy. This Program:
- Is not insurance.
- Does not constitute an unconditional or absolute guarantee of refund.
- Is a review, traceability, and support program subject to conditions and evaluation.
- Is applied case by case, at Causfy’s discretion and subject to these terms.
- Is governed by Spanish law. Causfy is domiciled in Spain and subject to EU legislation.
2. Non-Custodial Design and Technical Limits
Causfy is designed with a self-custody approach. Therefore:
- Causfy does not directly custody funds from donors or creators.
- Payments, KYC/KYB, withdrawals, and related functions may depend on authorised third-party providers ([Proveedor de pagos — pendiente]).
- Causfy does not guarantee the ability to reverse or recover funds once transferred to destinations controlled by users or to external systems. Any approved refund is considered a discretionary benefit of the Program, not an admission of liability.
3. Submission Window: 12 Months
Claims must be submitted within twelve (12) months from the date of the donation. Claims outside this period are not eligible.
4. Individual Claims (No Collective Liability)
Each claim is individual and can only be submitted by the donor who made the donation. Collective, coordinated, or third-party claims are not accepted.
5. Basic Eligibility
To be considered, the claim must:
- Refer to a donation made through Causfy (with verifiable reference: ID, receipt, or Tx),
- Be submitted within the deadline, and
- Include sufficient information for review (description + reasonable evidence).
6. Cases That May Be Eligible
Causfy may consider a refund when there is credible evidence of:
- Fraud / Material Misrepresentation: False or misleading central claims, determinative for the donation decision.
- Impersonation: Campaign created or presented under a deceptive identity.
- Unauthorized Fundraising: Campaign “on behalf of” a third party without reasonable authorization.
- Serious Breaches of Critical Rules: With direct impact on the donor.
7. Common Exclusions (Not Eligible)
This Program generally does not cover:
- Donor regret or change of opinion.
- Disagreement with results without evidence of fraud or material misrepresentation.
- Campaigns that do not reach goals, delays, or schedule changes (failure to reach a goal is not fraud).
- Network commissions, third-party fees, taxes, spreads, or indirect losses.
- Donations made outside Causfy’s flow or sent to external addresses by user decision.
- Claims without minimum evidence or lack of cooperation.
- Program abuse, false or repetitive claims.
8. No Double Recovery (Chargebacks / Disputes)
To avoid double compensation:
- If the donor initiates or has initiated a bank dispute/chargeback for the same donation, that donation is not eligible.
- If the donor receives a refund through another channel (bank, processor, third party), it is not eligible.
9. Refund Amount and Scope
If a claim is approved:
- The refund is limited to the eligible donated amount actually paid by the claimant,
- Excludes fees, network costs, taxes, indirect losses, consequential damages, or lost profits,
- And never exceeds the original amount of the eligible donation.
10. Refund Method
If applicable, Causfy may refund:
- To the original method when technically possible, or
- Through a reasonable alternative method (for example, stable asset) subject to availability, compatibility, and compliance. The availability of refund methods depends on the provider, country, and applicable regulation.
11. Cooperation and Anti-Abuse Verification
Causfy may request additional verification and documentation to prevent Program abuse. Lack of cooperation may result in claim rejection.
12. Discretionary Decisions
Causfy decides at its discretion, considering evidence, security, technical limitations, and applicable legal or regulatory restrictions under Spanish and EU law.
13. Applicable Law and Dispute Resolution
These Program terms are governed by Spanish law. In the event of a dispute, the parties shall first attempt informal resolution. If unresolved, mediation under Spanish Law 5/2012 is available. Failing that, disputes shall be submitted to the competent courts of Madrid, Spain. EU consumers retain any mandatory rights conferred by EU consumer protection law.
14. How to Submit a Claim
Claims are submitted through the official form published by Causfy. The submission must include:
- Donation or transaction reference,
- Campaign link,
- Description and evidence.
