Important Legal Notice: This Program is NOT an insurance product and does NOT constitute an absolute or unconditional guarantee of refund or fund delivery. It is a discretionary review, traceability, and support program. Causfy does not directly custody user funds. Any measure under this Program is discretionary and subject to technical, legal, and compliance limitations. These terms are governed by Spanish law.
1. Purpose
The Causfy Beneficiary Protection Program (“Beneficiary Program”) provides a formal review pathway when there is credible evidence that:
- a campaign was created “on behalf of” a Beneficiary without authorization, or
- the named Beneficiary will not receive the funds as represented. This Program:
- Is not insurance.
- Is not an absolute guarantee of fund delivery or refund.
- Is a review, traceability, and support program subject to conditions and evaluation.
- Is evaluated case by case, at Causfy’s discretion.
- Is governed by Spanish law. Causfy is domiciled in Spain and subject to EU legislation.
2. Non-Custodial Design and Limits
Causfy does not directly custody user funds. Payments, payouts, and related functions may depend on authorised third-party providers ([Proveedor de pagos — pendiente]). Causfy does not guarantee technical recovery of funds transferred to self-custodied or external destinations. Any measure under this Program is discretionary and subject to technical and legal limitations.
3. Proof-of-Control for On-Chain Destinations
When the destination is a wallet, Causfy may require proof-of-control to validate that the Beneficiary controls the receiving destination:
- Causfy issues a nominal value challenge using a stable value asset on a compatible network.
- The Beneficiary demonstrates control by responding to the challenge from the indicated wallet.
- This proves control of the destination, but does not substitute legal verifications when required.
4. What Causfy Can Do
Based on evidence and risk, Causfy may:
- Restrict or unpublish campaigns,
- Request additional validations,
- Apply beneficiary confirmation flows,
- And/or take enforcement measures for policy violations. In some cases, Causfy may decide that the appropriate resolution is to refund donors, rather than transfer funds to the Beneficiary, if this is appropriate for security, evidence, or compliance reasons.
5. Cooperation and Documentation
Causfy may request evidence of relationship, authorization, or representation (if applicable), as well as reasonable attempts to contact the organizer.
6. Applicable Law and Dispute Resolution
These Program terms are governed by Spanish law. In the event of a dispute, the parties shall first attempt informal resolution. If unresolved, mediation under Spanish Law 5/2012 is available. Failing that, disputes shall be submitted to the competent courts of Madrid, Spain. EU consumers retain any mandatory rights conferred by EU consumer protection law.
7. How to Submit a Claim
The claim is submitted through the official form published by Causfy and will include:
- Campaign link,
- Reason for the claim,
- Available evidence,
- And, if applicable, destination and acceptance of the proof-of-control process.
